Man Says Judge Arrested Him ‘On a Hunch’
NASHVILLE (CN) – A judge in Dickson County, Tenn., had officers pull a spectator out of his courtroom “on a hunch,” held him in custody and made him submit to a urinalysis for drugs, the man claims in Federal Court. Benjamin Marchant claims that General Sessions Judge Durwood Moore admitted that he “routinely drug-screens ‘spectators’ in his courtroom if he ‘thinks’ they may be under the influence of drugs or alcohol.” Moore allegedly called it the “routine policy of the court.”
Routine policy? Fortunately, someone else had read the Constitution.
Moore acknowledged he had violated Marchant’s rights and was censured by the Tennessee Supreme Court’s Judiciary Court on May 1, 2009, the highest form of punishment short of seeking a judge’s removal from the bench, according to the complaint.
The court ordered Moore to “never violate a person’s constitutional rights as he did to the Plaintiff,” the complaint states.
Really. How does this guy get to be a judge? You have to be better informed to get a cosmetology license.
Wholly hell! It seems to me more and more that our rights no longer matter. Our constitution is just decoration. Anyone wanna take bets that if someone hadnt stood up to this judge he would still be playing god?
Sometimes I wonder if acts like this is just a conditioning to a coming enslavment of the people.

My father was offered a judgeship years ago, but he couldn’t come up with the requisite funds. (they aren’t inexpensive.)

Elected judges who deliberately exceed their boundaries to kick someone around are an epidemic in the United States, especially in backwater courts. Countering these evildoers is possible. Usually it works to find an attorney who hates the offending judge so much he’ll charge less or maybe do the whole complaint gratis.
Locating a disgruntled attorney shouldn’t be difficult. Judges don’t discriminate when they generate victims on the scale of those mugged by Judge Durwood Moore. Though it doesn’t sound as if Judge Moore really understood his behavior was inappropriate, which is scarier still.

Don’t forget. Even judges come up for reelection on some state ballots. Get to know who they are so you can do something about it. Ask around. Take a day, hang out at the court house and talk to attorneys. You’ll have no trouble voting after that.
Pete, I respect your journalism…but respect this judge, or drug warriors, dea or even narrow minded congressmen….I have no respect for…they are power mad and lining their pockets…
This is just one example. Has anyone heard or seen anything about the sheriffs deputy in Phoenix that stole a document from a defense attorney’s briefcase,in open court and on camera?
The sheriff,a guy that was Noriega’s DEA liason,said the deputy acted within his jurisdiction and was justified and had done nothing wrong. The “judge” got t’d off at the defense attorney for getting angry because of the violation of the plaintiffs rights violated. They reported it on CNN,and that is the last I heard of it.
It happened shortly before thanksgiving. Anyone in the Phoenix area that has heard more.
If you are not acquainted with the Noreiga cocaine deal,
he was allowed to traffic cocaine by our government,until he wouldn’t play the way they wanted him too.
The drug test (purity oath) is used like the TAZER. It’s not about helping a victim, it is about pain compliance and control. I would have loved to hear that Mr. Marchant’s reply to the judge’s order was,
“OK, open wide, your highness!”
as he proceeded to drop trou. Priceless!!!!
I would imagine that statement would have been followed by a fusillade of TAZER darts aimed at Mr. Marchant.
Maybe he could duck, like President Bush did when that guy flung shoes at him and all the darts would hit the judge, that would be awesome.
That scene would fit right into the remake of Cheech and Chong’s “Up in Smoke”, during the “I was framed” song in the court room.
Then the judge could say,
“Don’t TAZE me bro.”
I’ll be in town all week. Don’t forget to tip the waitress and try the veal.

Can the Drug Subculture Be Beaten?
‘Build resistance from within’ is the advice a no-nonsense educationist keeps giving to parents and guardians, living in constant dread of the drug scene in Bangladesh. But those of the conservative bend, a Victorian mindset, as it were, still insist that a ‘good thrashing’ would be the perfect medicine for brats — before they become die-hard delinquents — should advice/counseling/warning/ fail to bring them back to normalcy.
But what is ‘normal’, in the Bangladesh context ? It obviously isn’t the same for all socio-economic classes, although every full-blooded Bengali, high or low, still holds traditional family and community values dear — where the elderly retain leadership within the extended family and the villages, and have a say in the upbringing of the young ones. That would be considered anathema in today’s upcoming, individualistic models of family in urban Bangladesh. More and more of this bracket of society tend to emulate the west — albeit selectively.

The deputy sheriff was eventually charged with Contempt of Court by another judge. He was ordered to make a public apology as well as spend a couple nights in jail. I don’t think Arpio (sic?) has let the deputy do either jail time or make the apology ordered.
Now the deputy is suing to block his having to make an apology by using 1st Amendment. His take is that no one can order another to speak.
Seems that the Sheriff of Maricopa county does what he wants when he wants how he wants regardless of the Constitutional rights of anyone he wants to go after.
They have there Tazers and I have my .45!
Sounds like the sherrif has the mind set of many “leaders” in our country. Do as I say not as I do, no debate, debate is over.
If you haven’t already seen it, you ought to have a look at the You tube video of the deputy stealing the document in court. It is amazing. Watch the judge’s body language and tone of voice.
I find the situation there fascinating. I hate what the law has become and how it is used, I hate courts, I hate prosecutors and I hate cops. (that’s a generalized hate–some of them are quite nice in person). The sheriff is no good and totally out of control, and so is the DA. The judges seem to be actually afraid of the cops–I mean, personally, physically afraid of them. Nobody seems to be able to do anything about it.
It is hard to feel sympathy for despotic judges because they hurt so many people, but I can almost muster some sympathy for these ones. When conflicts between different groups of bullies happen, I often wish they all could lose, but rarely do I see it granted.
So I hope they keep going at it. The more they damage each other’s reputations and the rule of law in Maricopa county, (such as it is there) the better. It should be very entertaining to watch.
If you get into “the system” in any way, shape, or form you are screwed. People wind up with the pigs filing some trumped up charge against them with the possibility of serious consequences being very real. Then, the DA will make a plea bargin deal requesting that you plead guilty to a lesser charge with little to no consequence (except having a criminal conviction on your record and paying a fine + court costs.) The result of all of this is people pead guilty to crimes they innocent of rather that taking the risk of going to jail for a lenghty period of time. Justice is not the goal, but rather, the money dervied from the fine along with a conviction to go on the DA’s resume’.
